1. Introduction
Sirène app
This app is a platform for a volunteer community where you, selected contact persons and other volunteers together create a network of people who want to create safety for everyone and where you can ask for help if you find yourself in an unsafe situation if you have connected a Sirène alarm device to the Sirène app.
Terms of Use
These terms and conditions ("Terms of Use") are designed to apply to Sirène app users in Denmark and Germany, whether you sign up to provide reassurance when an alarm is triggered ("Contact") and/or if you connect your Sirène alarm device and can ask for help in an unsafe situation ("Carrier").
Parties to the agreement
When you create a profile in the Sirène app as the Contact and/or Carrier, you enter into an agreement with SIRÈNE OOONO ApS, Company Registration (CVR) No. 40429352, Gearhalsvej 1, DK-2500 Valby ("SIRÈNE OOONO").
Personal data
SIRÈNE OOONO processes personal data about you in order to give you access to our community and to document our compliance with legislation, marketing and enable business development. You can read more about what SIRÈNE OOONO records, how SIRÈNE OOONO uses your personal data and your rights in our privacy policy.
2. Options in the Sirène app
2.1 Purpose
The purpose of the Sirène app is to allow you to be part of a community where you can both help keep others safe and ask for help if you find yourself in an unsafe situation. The Sirène app community is thus based on selected contact persons (Contacts).
To be a part of this community, you must always have a good tone and act responsibly.
2.2 Activating the Siren alarm device only calls Contacts
If you are in an unsafe situation and you trigger your Siren alarm device, an alarm will only be sent to your selected Contacts. The Sirène app cannot automatically or when an alarm is triggered call the authorities' alarm and control centre.
2.3 The option to be a Carrier of a Sirène alarm device
You can register as a Carrier when you connect your Sirène alarm device.
The Sirène alarm device must be purchased separately. When you sign up as a Carrier, you can also become a Contact for others if you fulfil the age requirements.
2.3.1 As a Carrier, you can trigger your Sirène alarm device with a single press if you
are in an unsafe situation. When the Sirène app receives the signal, the Sirène app sends a message to your Contacts. Messages will always be sent to your Contacts, no matter where they are.
2.3.2 Please note that your location is based on the location of your mobile device.
Therefore, you cannot use your Sirène alarm device without it being connected to your mobile device. It is the location of your mobile device that determines where Contacts will see your location.
2.3.3 Do not misuse your Sirène alarm device. This means that you can only trigger your
Sirène alert device in situations where you feel unsafe, and only for the purpose of calling for help from your Contacts. You are also responsible for complying with applicable law and are furthermore responsible for only using your Sirène alarm device in accordance with the User Manual available at www.sirene.ooono.com.
2.4 The option to be a Contact
As a user, you can sign up on the Sirène app as Contact. A Contact is a physical person who wants to create a sense of security and make it safe for everyone to move around everywhere. You can become a Contact in the Sirène app for specific Carriers of a Sirène alarm device. This could be family members or close friends, for example.
2.4.1 You will always be notified if one of the people you have a Contact with triggers their Sirène alarm device, regardless of your location.
2.4.2 You can respond to a notification by offering your help. Once you have offered your help, the Sirène app will connect you as a Contact to the location of the triggered Sirène alarm device. Whether you choose to respond to a notification is voluntary.
2.4.3 As a Contact, you must always take care of yourself. Your role is solely to provide peace of mind. You need to
therefore not violate applicable law.
3. What does it take for you to sign up in the Sirène app
3.1 Access
To access the Sirène app, you need to create and register an account. You will need to provide the following information:
- E-mail address
- Gender
- Name
- Date of birth
3.2 You are responsible for providing the correct information
As a user, you are responsible for ensuring that the above information is correct, complete and up-to-date at all times.
3.2.1 Your account may only be used by you and you may not transfer or make your account available to other users.
3.3 Login
When you register in the Sirène app, you need to confirm your e-mail with an activation code. Every time you log in to the app, you will receive a code via your e-mail. You are therefore required to ensure that you only have access to your e-mail.
3.4 Deleting a user
If you delete your user in the Sirène app, you need to confirm your e-mail with a code. This should be seen as a measure to ensure your user is not wrongfully deleted.
3.5 Invite Contacts
You can create a Contact in the Sirène app by adding the ID code of the person you want to create a Contact with. This feature is only possible if the other person has also downloaded the app and accepts the request. You will be able to see each other's name.
4. Prerequisites for using the Sirène app
4.1 Age limit for Carriers and Contacts
You must be at least 13 years old to create a Carrier account, and in Denmark, it requires authorisation from your legal guardian(s) until you are 15 years old, while in Germany it is until you are 16 years old.
The Sirène alarm device is not intended to be carried by persons under the age of 13.
You must be at least 15 years old to help someone you have a Contact with. In Germany, your legal guardian(s) must have authorised this until you are 16 years old.
4.2 Access to the Sirène app
To make use of the Sirène app, you must have:
- Access to a mobile device (e.g. a smartphone) that has internet access and is compatible with the Sirène app.
- Please note that the Sirène app does not exist in countries other than Denmark and Germany, so it cannot be expected that the app is available and functional outside Denmark and Germany.
- An e-mail address.
4.3 Access as a Carrier
To make use of the Sirène app as a Carrier, you must also have a Sirène alarm device. Your Sirène alarm device must be purchased separately from our online shop.
4.4 Allow features on your mobile device
To make use of the options in the Sirène app, you must allow the "always GPS location" and "notifications" feature and/or a similar feature on your mobile device. As a Carrier, you must also allow the Bluetooth feature for your mobile device to connect to your Sirène alarm device.
Please note that location is not always 100% accurate and is affected by buildings, signal strength, telecom networks, your mobile device, etc. SIRÈNE OOONO therefore does not accept responsibility for the location feature in the Sirène app correctly indicating the location of the Carrier or Contacts.
4.5 Liability for expenses
SIRÈNE OOONO is not responsible for any expenses you may incur when using the Sirène app, including data usage costs.
4.6 Respect for the rights of others
You may not post content or take actions in the Sirène app or use the Sirène alarm device in violation of the rights of others, our rights or otherwise in violation of applicable law. You must always comply with our Terms of Use when using the Sirène app.
4.7 Indemnification
You agree to indemnify SIRÈNE OOONO without limitation for any and all liability regarding to and arising out of your use of the Sirène app and the Sirène alarm device.
5. SIRÈNE OOONO's rights and obligations
5.1 Right to enter into agreements with business partners and subcontractors
SIRÈNE OOONO is authorised to enter into agreements with partners and subcontractors in order to enable you to use the Sirène app.
5.2 Right to change the Terms of Use
SIRÈNE OOONO has the right to modify the Terms of Use. If the Terms of Use are changed, this will be done after a notification. Less significant changes to the Terms of Use will be notified via the Sirène app, while
Significant changes will be notified to you individually by sending a notification to the e-mail address you have recorded in your account in the Sirène app. The notification will be sent 30 days before the new terms come into effect. If you then continue to use the Sirène app, you are deemed to have accepted these changes.
5.3 Right of transfer
SIRÈNE OOONO is entitled to transfer its rights and/or obligations, in whole or in part, and otherwise dispose of its rights and obligations, in whole or in part, without your prior consent.
5.4 Accessibility
The Sirène App is provided "as is" and "as available" to the fullest extent permitted by applicable law, without guarantees of any kind, either express or implied, including, but not limited to, implied guarantees of fitness for a particular purpose, title and non-infringement. SIRÈNE OOONO does not state or guarantee that:
- The Sirène app will always be secure, error-free or timely.
- The Sirène app will always work without delays, interruptions or defects.
- Content, user content or information provided to you on or through the Sirène app is timely or accurate.
5.4.1 Occasionally, SIRÈNE OOONO may need to disconnect the Sirène app to perform
changes to certain technical specifications.
5.5 Monitoring the Sirène app
SIRÈNE OOONO monitors content in the Sirène app, but SIRÈNE OOONO cannot guarantee that the Sirène app is free of material or other content that may be considered unacceptable. When SIRÈNE OOONO becomes aware of it, SIRÈNE OOONO will review the content to determine the severity of the content and whether it violates the Terms of Use and applicable law, and SIRÈNE OOONO may remove it. In serious cases, SIRÈNE OOONO may also notify the police.
6. Licence
6.1 Licence
SIRÈNE OOONO grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable licence to access and use the Sirène App.
7. Intellectual property rights
7.1 Intellectual property rights
All intellectual property rights relating to the Sirène app are owned or licensed by SIRÈNE OOONO. None of these rights are transferred to you. You may therefore not copy, distribute, sell, publish, transfer, assign, lend, sublicense, modify or otherwise dispose of the software contained in and associated with the Sirène app.
8. Limitation and disclaimer of liability
8.1 SIRÈNE OOONO's liability
SIRÈNE OOONO shall be liable for damages if SIRÈNE OOONO fulfils agreed obligations late or inadequately due to significant errors or omissions caused by gross negligence or intent.
8.2 Incorrect use of the Siren alarm device
SIRÈNE OOONO bears no responsibility if you do not use the Sirène alarm device as prescribed in our User Manual, available at www.sirene.ooono.com. Before you start using the Sirène
alarm device, you should carefully read the User Manual, which you can find at www.sirene.ooono.com.
8.3 Incorrect use of the Sirène app
SIRÈNE OOONO bears no responsibility if you do not use the Sirène app as prescribed in the Terms of Use. Before you start using the Sirène app, you should read the Terms of Use carefully.
8.4 Limitation of liability
To the extent permitted by law, SIRÈNE OOONO shall not be liable for any indirect, incidental, special, consequential, punitive or multiple damages or loss of profits or revenue, whether direct or indirect, or loss of data, use, goodwill or other intangible losses arising out of:
- Your access to or use of or inability to access or use the Sirène app.
- The behaviour or content of other users or third parties on or through the Sirène app.
- Unauthorised access, use or modification of your content.
- The user's actions or omissions in connection with the use of the Sirène app.
- Other actions that violate your freedom, peace, honour or person.
8.5 Furthermore SIRÈNE OOONO is not responsible for:
- Interruption of availability caused by (i) failure of your hardware/equipment, network connection, software or other circumstances for which you are responsible under the Terms of Use, or (ii) software failures, viruses or other attacks on security or otherwise due to technical complications or maintenance.
- Any links in the Sirène app to other websites owned by third parties. Such links are provided for your convenience only and SIRÈNE OOONO assumes no responsibility for the content, accuracy of information or privacy practices of such websites.
- Harm resulting from strike, fire, government action, labour disputes, accidents, subcontractor failure or delay, interruption of public communication systems or other circumstances beyond SIRÈNE OOONO's control and which SIRÈNE OOONO could not reasonably expect and whose consequences SIRÈNE OOONO could not reasonably avoid or overcome.
- SIRÈNE OOONO only provides the service and will not be responsible for your experiences as a Contact.
9. Choice of law and venue
9.1 Choice of law
These Terms of Use shall be governed by and construed in accordance with the laws of Denmark.
Regardless of the above provision, the consumer shall not be deprived of the protection afforded by the mandatory provisions of the law of the country in which they have their habitual residence.
9.2 Venue
Any dispute, controversy or claim arising out of or in connection with the use of the Sirène app or these Terms of Use shall be settled by the courts of the Member State in which the consumer is habitually resident.
Alternatively, the consumer may choose to bring an action before the Danish courts at SIRÈNE OOONO's venue, which is the Court of Frederiksberg, Howitzvej 32, DK-2000 Frederiksberg.
